Terms and Conditions for Athletes and Guardians
Effective Date: [April 2026]
These Terms and Conditions (“Terms”) form a legally binding agreement between you (the “Client,” including the athlete and/or their legal guardian if the athlete is a minor) and The League Winners (“we,” “us,” or “TLW”), a consulting firm providing advisory services to athletes. By engaging our consulting services—whether through subscription, one-on-one consultations, or any related guidance—you acknowledge that you have read, understood, and agree to these Terms.
If the athlete is under the age of majority (typically 18) in their jurisdiction, a parent or legal guardian must review and accept these Terms on their behalf and confirm legal authority to do so.

1. Description of Services

The League Winners offers non-exclusive consulting and advisory services to support athletes, including but not limited to:
  • Assistance with finding and evaluating potential representation (agents, advisors, etc.)
  • Media training and preparation
  • Identifying and pursuing media opportunities
  • Guidance on contacting recruiting coaches or programs (subject to applicable rules)
  • Support in exploring Name, Image, and Likeness (NIL) opportunities
  • Event planning and life/career planning advice

All services are advisory and educational only. We do not act as licensed athlete agents, negotiate contracts on your behalf, manage your affairs, or provide legal, tax, or financial advice unless explicitly agreed in a separate written engagement with qualified professionals. We do not guarantee introductions, deals, opportunities, or outcomes.

Services are provided based on publicly available information, general knowledge, and our experience at the time of delivery. You remain solely responsible for all final decisions, compliance with rules, and execution of any opportunities.

2. No Guarantees or Warranties

Athlete outcomes in recruiting, NIL, media, representation, or career development depend on many unpredictable factors, including performance, market conditions, third-party decisions, injuries, eligibility rules, and luck.
We make no guarantees, representations, or warranties of any kind—express or implied—regarding success, results, accuracy, or specific outcomes from our consulting services. Past results or examples do not predict future success. All decisions based on our advice are at your sole discretion and risk.
Services are provided on an “as is” and “as available” basis without warranties of merchantability, fitness for a particular purpose, or otherwise.

3. Compliance with Rules and Laws

You agree to use our services only in full compliance with:

  • All applicable NCAA, conference, high school, or amateur athletics rules and eligibility requirements
  • State and federal laws governing NIL, athlete agents, endorsements, and disclosures (including any required registration or reporting)
  • Your school/institution’s policies
  • FTC guidelines on endorsements and disclosures

We are not responsible for any loss of eligibility, violations, or penalties resulting from your actions or decisions. You must independently verify all compliance matters and consult qualified legal/tax professionals as needed. We do not represent you in negotiations with professional teams or organizations where prohibited by law.

Disclosure: You are responsible for making any required disclosures of our consulting relationship or resulting opportunities to your school, conference, or governing body.

4. Client Responsibilities and Eligibility

  • You represent that you (or the guardian) have the legal capacity to enter this agreement and that all information provided to us is accurate.
  • Guardians: You confirm you are the legal guardian and authorize the minor athlete’s participation.
  • You agree to act lawfully, avoid collusion or rule violations, and handle all taxes, reporting, and obligations arising from any opportunities.
  • You are solely responsible for your athletic eligibility, contracts, NIL deals, media appearances, recruiting communications, and personal decisions.

5. Limitation of Liability

To the fullest extent permitted by law, The League Winners, its owners, consultants, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Use of or reliance on our services or advice
  • Any missed opportunities, failed introductions, or unfavorable outcomes
  • Loss of eligibility, financial losses, or other harms

Our total liability, if any, shall not exceed the total fees paid by you to us for the specific services in the 12 months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless The League Winners and its personnel from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of our services
  • Any decisions or actions taken based on our advice
  • Any violation of these Terms, applicable rules, or laws by you or the athlete

7. Intellectual Property

All materials, training content, strategies, templates, analyses, and resources provided by The League Winners are our proprietary intellectual property. You receive a limited, personal, non-exclusive, non-transferable license to use them solely for your own personal development.

You may not copy, distribute, modify, sell, or publicly share our content without prior written consent. Unauthorized use is prohibited.

8. Fees and Payment

Fees are as published on our platforms or agreed in writing. Payments are generally non-refundable except as explicitly stated for a specific service. We reserve the right to modify fees with notice.

Subscriptions may auto-renew unless canceled per the signup terms. Separate success-based or commission fees (if any) will be detailed in a specific written agreement.

9. Termination

We may terminate or suspend services at any time for any reason, including suspected violations. You may cease use at any time; ongoing subscriptions must be canceled according to their terms.

Upon termination, the license to our materials ends, and any unpaid fees remain due.

10. Confidentiality and Privacy

We respect your privacy. Personal information is handled per our Privacy Policy (if applicable). We do not share your details except as required by law or with your consent. You agree not to disclose our proprietary methods or materials.

11. General Provisions

  • Governing Law: Governed by the laws of the United States and the State of New York, without regard to conflict of laws rules.
  • Dispute Resolution: Disputes shall be resolved by binding arbitration in New York or, if unenforceable, in the courts of the state in which the offense is being occurred.
  • Entire Agreement / Severability: These Terms constitute the full agreement and supersede prior understandings. Invalid provisions do not affect the rest.
  • Changes: We may update these Terms. Continued use after changes means acceptance.
  • No Agency Relationship: Nothing creates an agency, partnership, or fiduciary relationship beyond the advisory services described.

12. Acknowledgment and Agreement

By engaging The League Winners’ services, you (and the guardian, if applicable) confirm that:

  • You understand the advisory/educational nature of the services and the associated risks.
  • You accept full responsibility for compliance, decisions, and outcomes.
  • You release The League Winners from liability as outlined.
